Does someone owe you money and refuse to pay, even after a judgment? Or are you so deep in debt that you no longer see a way out? In both cases, judicial law offers solutions: attachment (seizure) to collect your claim, or a collective debt settlement to make your debts manageable again.
Devoldere Advocaten assists both creditors and debtors from Izegem and the surrounding area.
How can we help you?
- Protective attachment: where there is a risk that your debtor will make assets disappear, his goods or funds can be frozen in advance.
- Enforcement attachment: actually collecting your claim on the basis of a judgment or other enforceable title, for example through attachment of wages, bank accounts, movable property or a home.
- Challenging an attachment: defending debtors and third parties against an unjustified or excessive attachment.
- Collective debt settlement: assistance with the application and follow-up of the procedure, for debtors and creditors alike.

Frequently asked questions
I have a judgment, but my debtor still does not pay. What now?
With an enforceable judgment, a bailiff can levy an attachment, for example on your debtor’s wages, bank account or goods. Together with you and the bailiff, we choose the most efficient route.
Can I have an attachment levied before there is a judgment?
In certain cases, yes, through a protective attachment. Your claim must then be sufficiently certain and there must be urgency, for example because the debtor is trying to dispose of his assets. We assess whether your situation qualifies.
My wages or bank account have been attached. Can I do anything about it?
Part of your income is protected by law and cannot be attached. If the attachment is unjustified or goes too far, it can be challenged. Have it reviewed quickly.
I can no longer pay my debts. What is a collective debt settlement?
It is a court procedure for individuals with a serious debt problem. The court appoints a debt mediator, who draws up a plan to repay your debts as far as possible over a certain period. In the meantime, you are protected against new attachments. We help you assess whether the procedure suits you and file the application correctly.
One of my customers is in a collective debt settlement. What does that mean for me as a creditor?
You must declare your claim to the debt mediator in time and you can respond to the proposed plan. We protect your rights in the procedure.
How much does a lawyer cost?
We make clear agreements about fees in advance. You may be entitled to a pro bono lawyer (pro deo), or your legal expenses insurance may cover the costs. More information on our Fees page.
